2. Rights of the person concerned

(1) You have the following rights against us regarding personal datarelated to you:

(3) Objection to the processing of your data

If the processing of your personal data is based on a balance of interests,you may object to the processing. This is the case if the processing is notnecessary to fulfil a contract with you, which will be displayed by us in thecorresponding description of the functions. When exercising such objection, weask you to explain the reasons why we should not process your personal data. Inthe event of your justified objection, we will examine the situation and eitherstop or adjust the data processing or explain to you our compelling worthy ofprotection reasons, on the basis of which we will continue with theprocessing. Of course, you can object to the processing of your personaldata for purposes of advertising and data analysis at any time. 3. Data security

Since the security of your data is important to us, your personal data istransmitted with secure SSL or TLS connection. TLS (Transport Layer Security)or the previous version SSL (Secure Socket Layer) is a protocol for encryptingdata transmissions on the internet. We hereby protect your personal data fromexternal access. You can recognize the encryption of the connection in thebrowser line “https//:” or the lock symbol.We also protect or website and othersystems through technical and organisational measures against loss,destruction, access, modification or distribution of your data by unauthorisedpersons. Despite regular checks, a complete protection against all threats isnot possible.

4. Visit our website 

When using our website for information purposes only, i.e. also when you notregister or otherwise provide us with information, we only collect the personaldata that your browser transmits to our server. As soon as you request any filefrom our site, access data will be collected and stored as standard.This datarecord comprises: 

• the web page, which the file was requested from,

• the name of the file,• date and time of requirement,

• the transferred data amount in each case,

• the access status / HTTP status code (i.e. whether the file wastransferred or possible not found, etc), 

• a description of the type and version of the web browser used,

• the installed operating system, the language of the operating system andthe set resolution,

• the IP address used,

• location data (city, country).

This data is necessary for us to display our website and to guaranteestability and security. Furthermore, these are evaluated for internalstatistical purposes and for the technical administration of the website. Thelegal basis is Art. 6(1) sentence 1 lit. f GDPR. Our legitimate interestfollows from the aforementioned purposes of data collection. 

This access data will be deleted not later than seven days after theprocess, unless we have been able to detect an abuse. We will then continue tostore the access data for prosecution. The legal basis is Art. 6(1)sentence 1 lit. f GDPR.

5. Registration in the partner network

(1) You can register in the Brabender partner network. In the courseof opening an account, the following personal data is collected: Title, firstname, surname, address, e-mail address, telephone number. For the purpose ofusing your personal data for the use of our services, the data you provide willbe stored and processed on a revocable manner. The legal basis is Art. 6 (1)sentence 1 lit. b GDPR.

(2) If you terminate your membership in the partner network, youraccount and also your personal data stored by us will be deleted. 

6. Newsletter

(1) By ordering our newsletter you are indicating your consent to useyour e-mail address for our own advertising purposes (so-called directadvertising). 

Permission to send the newsletter

"I would like and I agree to be informed by post, e-mail and telephone about used equipment on the markplace as well as about current own testing and measuring instruments and related services of Brabender GmbH & Co. KG. Your consent can be revoked at any time (e.g. by e-mail or to the contact details given in the imprint). The newsletter will be sent according to our data privacy policy."

(2) We use the so-called double-opt in when registering for ournewsletter. This means that after registering with your e-mail address you willfirst receive an e-mail with an activation link in order to confirm yourregistration. Only after you have clicked the activation link, the registrationhas taken place. During registration and in addition to your e-mail address, wealso store your IP address and the time of registration and confirmation. Thecollection of this data serves to prevent any misuse of external data as wellas to prove your registration. 

(3) If a registration is not confirmed witһin 24 hours through theconfirmation link, the stored data within the registration will beautomatically deleted.

(4) To subscribe to the newsletter, only your e-mail address isrequired. The indication of further, separately marked data is voluntary and isused to be able to address you personally. After sending your confirmation, westore your e-mail address for the purpose of sending you the newsletter inwhich we inform you about our products and services. The legal basis for theprocessing of your personal data is your consent according to Art. 6 (1)sentence 1 lit. a GDPR.

(5) You can withdraw your consent to the storage and use of youre-mail address for sending the newsletter as well as the subscription to thenewsletter can be cancelled at any time, e.g. by sending an e-mail or byclicking on the link at the end of each newsletter.

(6) For sending our newsletter we use Newsletter2Go, which isoperated by Newsletter2Go GmbH, Berlin, Germany. For this purpose, your datawill also be stored by Newsletter2Go. Newsletter2Go offers evaluation options,how the newsletters are opened and used. Your data will not be passed on tothird parties for the purpose of receiving the newsletter and Newsletter2Godoes not acquire the right to pass on your data.Newsletter2Go will neither haveaccess to the data of newsletter recipients nor use it in any other way. Thenewsletter tool analyses the reach of the respective newsletter to ensure thatthe broadcasts actually reach the recipients. The recognizable individualbehaviour patterns are only used for a statistical evaluation of the success ofthe newsletter and under no circumstances passed on to third parties or usedfor other purposes.We have an order processing contract with Newsletter2Go. 7. Follow-up contacts via e-mail

(1) By consenting to be contacted by e-mail, you agree that we mayuse your e-mail address for information about our products and services.

(4) For the registration to the e-mail sending only the indication ofyour e-mail address is necessary. The indication of further, separately markeddata is voluntary and is used to be able to address you personally. The legalbasis is Art. 6 (1) sentence 1 lit. a GDPR.

8. E-mail contact and contact form

(1) In the course of contacting us by e-mail or using the contactform on our website, personal data is collected and stored by us. If you takeadvantage of the contact form, the personal data entered into the input maskwill be collected. The indication of your telephone number takes placevoluntary. By contacting us via e-mail following personal data will becollected and stored: e-mail address.

(2) We process the provided data exclusively for processing yourcontact enquiry. The legal basis is Art. 6 (1) sentence 1 lit. b GDPR or ourlegitimate interest in responding to your request in accordance to Art. 6 (1)sentence 1 lit. f GDPR. The legal basis for the processing of your telephonenumber is Art. 6 (1) lit. a GDPR.

(3) If the storage is no longer necessary, we will delete allpersonal data collected in this context. In the course of an enquiry by e-mailor contact form, your personal data will be deleted as soon as the conversationis finished, unless a contractual relationship follows, during the duration ofwhich further processing is permitted. The legal basis is Art. 6 (1) lit. bGDPR. The conversation is finished when it can be assumed that the matter hasbeen clarified. Provided there is a legal obligation to retain data, processingis limited to this purpose. The legal basis is Art. 6 (1) lit. c GDPR.

9. Ordering trade fair vouchers using the form

(1) In the course of ordering trade fair vouchers using the form onour website, we will collect and store following personal data: Title, name,e-mail address, company name, country. The disclosure of your telephone numberis voluntary. 

(2) We process the data provided by us exclusively for processingyour order. The legal basis regarding the mandatory disclosures is Art. 6 (1)sentence 1 lit. b GDPR. The legal basis for processing your telephone number isArt. 6 (1) lit. a GDPR.(3) If storage is no longer necessary, we willdelete all personal data collected in this context. In case of ordering tradefair vouchers, we will delete your personal data after the trade fair for whichthe vouchers were ordered has ended, unless a contractual relationship follows,during the duration of which a further processing is permissible and/or anenquiry and/or an application to our partner network. If a legal storageobligation exists, the processing is limited to this purpose. The legal basisis Art. 6 (1) lit. c GDPR.  

10. Use of our Marketplace

(1) We provide a so-called Marketplace for the sale of usedlaboratory devices. Through the Marketplace, laboratory devices will be offeredfor sale by us or by registered users. The purchase contracts are thenconcluded directly between the two parties outside theMarketplace.  If you wish to use our Marketplace, you will berequired to provide the personal information we need to create your sellerprofile or buyer enquiry in order to contact the other party. Required data forthe handling of the usage relationship are marked separately, further data arevoluntary. We process the data you provide to create your seller profile andoffer as well as to establish contacts. The legal basis is Art. 6 (1) sentence1 lit. b GDPR.

(2) In order to be able to appear as a seller on the marketplace,registration is required. When registering as a seller, following personal datais collected with the registration form: E-mail address, title, first name,surname, address, telephone number. The data entered by the user in themarketplace is stored and made available in the public area of the marketplacefor other registered and non-registered users to retrieve. #

(3) Contact with the seller is established by means of an applicationform. This can be used without prior registration. When you use our enquiryform, following personal data is collected and forwarded to the respectiveseller: E-mail address, title, first name, surname, address, telephone number.After the data has been forwarded to the seller, we will delete your personaldata, unless you have registered in the Marketplace. 

(4) In the event of termination of your user profile, your accountand also your personal data stored by us will be deleted

11. Surveys on this website

We use the services of Survio. This allows us to post and conduct surveyswith you. The supplier is Survio s.r.o., Hlinky 995/70, 603 00 Brno, CzechRepublic (“Survio”). The legal basis is Art. 6 (1) sentence 1 lit. f GDPR,whereby the legitimate interests arise from the aforementionedpurpose. For a survey you may be redirected to a Survio website or thiswill be integrated into our website via iFrame. 14. Marketing-Tools

Use of Google Adwords Conversion-Tracking/RemarketingWe use the offer ofGoogle Adwords using the so-called conversion tracking. These are services ofGoogle LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA("Google"), which serve to draw attention to our offers with the helpof advertising materials (so-called Google Adwords) on external websites. Wecan determine in relation to the data of the advertising campaigns howsuccessful the individual advertising measures are. Our purpose is to show youadvertisements that may be of your interest, to make our website moreinteresting for you and to achieve a fair calculation of advertising costs. Thelegal basis for the processing of your data is Art. 6 (1) sentence 1 lit. fGDPR, whereby our interest arises from the aforementioned purposes.

These advertising media are delivered by Google through so-called "AdServers". For this purpose, we use ad server cookies, through whichcertain parameters for measuring success, such as the insertion of ads orclicks by users, can be measured. If you access our website via a Google ad,Google Adwords stores a cookie on your PC. These cookies usually expire after30 days and are not intended to identify you personally. For this cookie, theunique cookie ID, number of ad impressions per placement (frequency), lastimpression (relevant for post-view conversions) and opt-out information (markthat the user no longer wishes to be addressed) are usually stored as analysisvalues.

Integration of YouTube videos

We have integrated YouTube videos into our online offer, which are stored onhttp://www.YouTube.com and can be played directly from our website. Theprovider is “YouTube”, a service belonging to Google LLC, 1600 AmphitheatreParkway, Mountain View, CA 94043, USA.

These are all integrated in the "extended data protection mode",i.e. no data about you as a user will be transmitted to YouTube if you do notplay the videos. Only when you play the videos the data mentioned in thefollowing paragraph will be transmitted. We have no influence on this datatransmission.

YouTube uses cookies to analyse your user behaviour. By visiting ourwebsite, YouTube receives the information that you have called up thecorresponding subpage of our website. In addition, the data collected by usmentioned above under section 4 “Visit our website” will be transmitted. Thisis independent of whether YouTube provides a user account through which you arelogged in or whether no user account exists. If you are signed in to Google,your information will be directly associated with your account. If you do notwish to be associated with your profile on YouTube, you must logout beforeactivating the button. 

YouTube/Google stores your data as user profile, evaluates it and uses itfor the purpose of advertising, market research and/or adaptation of itsinternet presence. Due to the embedding of YouTube videos, a connection to the Googleadvertising network DoubleClick is already established when a page is called upindependently of the video being played.
